High Court Spares Lead Prosecutor Samalie Wakooli in Katanga Murder Case

Highcourt has spared  lead prosecuctor  Samalie Wakooli from becoming a defence witness in the  the Katanga Murder case.

Justice Isaac Muwata ruled that a  mere preparation of the summary of evidence doesnot turn  a prosecutor a witness .

The judge has noted that the summary of evidence is  information disclosed to an accused to enable him / her  prepare their  defence. Court adds that the summary of evidence is proved by a way of calling witnesses that the defence team also have an opportunity to cross -examine .

The Judge explains that if the Katanga defence team has any queries with the contents of a DNA report mentioned in the summary of evidence  , a DNA analyst will be called as a competent  witness  and they will have a chance to cross-examine him.

The trial started today with state prosecutors led by Asst DPP Samalie Wakooli calling thier defence witness at the stand

Prosecution presented a medical Dr. Julius Muhwezi attached to the police’s Directorate of medical services at Nsambya.

Dr Muhwezi  who requested that his face is not shown on camera has testfied before the Highcourt that he examined  both the physical and menta status’ of 2 out of the 5  suspects in thus case case .

He says he examined 30 year old George Amanyire  the family’s shamba boy and 31 year old male nurse Otai Charles  and found out that both  had no  physical injuries seen on their  bodies  and that they  were  in a good mental status .

Dr. Muhwezi has further told court that he later filled his findings in a police form 24 and returned it to the investigating officer .

Molly is jointly charged with her daughters, Patricia Kakwenza and Martha Nkwanzi, as well as the medical doctor who first responded to the murder scene, Charles Otai, and a domestic worker at the Katanga residence, George Amanyire, who also face murder charges.

Businessman Henry Katanga Henry Katanga was found dead in his marital bedroom last November.
