Magistrate Throws out Prosecution Request to Access Besigye Phone Data

The Nakawa Chief magistrate’s court has declined to hear the prosecution’s request to access data on Dr. Kiiza Beisgye and Hajji Obeid Lutale’s mobile phones.

The court says it has declined the request on grounds that it lacks jurisdiction to do so since Beisgye and co-suspects were already committed to Highcourt . 

Besigye and his aide Lutale are charged with treason and have been incarcerated in Luzira prison since their arrest in November last year.

Dr. Besigye and Hajji Lutale have been remanded back to Luzira prison to await trial before the Highcourt.

The state through the Director of Public Prosecutions had requested for an order to have data retrieved from both phones in order to make its evidence solid against Dr. Besigye and Hajji Lutale. 

The same prosecution on 29th May 2025 presented committal papers sending Dr . Besigye and Hajji Lutale to the Highcourt hence rendering the magistrates Court at Nakawa redundant because it doesn’t have jurisdiction to hear capital offenses.

Besigye’s Lawyers say they are now going to pursue bail for their clients before the High Court. 

Lukwago also says the case against his clients should be withdrawn since the state has failed to obtain evidence to support its case.
