Supreme Court Kicks off Hearing Petition Challenging Museveni 2026 Victory
The Supreme court has started hearing an election petition filed by former presidential candidate; NPP’s Robert Kasibante who is challenging the victory of NRM’s YKM in the 15th/ January polls.
The court presided over by 9 justices is to first hear Kasibante’s application whichs Seeks orders to be allowed recover and inspect several documents and also perform a forensic analysis on EC’s Voter Biometric machines.
Kasibante through his lawyers; Julius Galisonga and John Isabirye want the documents to be adduced and used as evidence in a pending election petition he filed challenging the victory of president YKM7 in the January 15th election.
The justices on the panel are , Cheif justice Flavian Zeija, Mike chibita Percy Night Tuhaise , Christopher Madrama, Elizabeth Musoke , Stephen Musota , Catherine Bamugemereire, Monica Mugenyi and Muzamir Kibedi.
President Museveni who is listed as a respondent to this application is being represented by Ebert Byenkya and his son in-law Edwin Karugire.
In the application, Kasibante is asking the Supreme court to order the EC produce a complete list of all polling stations where voting took place, and certified copies of Declaration of Results forms from every polling station used in the presidential election.
In addition, Kasibante is seeking to have access to the backend infrastructure of the Biometric Voter Verification System, the Electronic Results Transmission and Dissemination System (ERTDS), and the tallying system used by the Electoral Commission at the National Tally Centre in Lubowa.
Kasibante wants permission to inspect these systems and to conduct a forensic analysis of both the electronic results transmission system and the tallying software.
According to the supporting affidavit, the materials will enable verification of voter identification, the conduct of polling, counting of votes at polling stations, tallying of results at district and national levels, and the overall integrity of the transmission and declaration of results.
In his presidential Petition, Kasibante of the National Peasants party voices concerns of failure by the Electoral Commission to properly gazette all polling stations used in the elections despite writing to the Electoral Commission requesting for the same .
However Kasibante who is also present at the hearing has suffered a blow after the court has unimously dismissed his application to adjourn today’s hearing in order for him to point out specific areas where he seeks recovery of the documets.
The court has instead ordered that all lawyers and thier parties meet for a scheduling confrence later in the afternoon or tomorrow so that they file a joint memorandum and submissions before the court reconvenes on 3rd/ February.
