The Court Orders Kayanja Sodomy Accusers to Stand Trial

The Court has ruled that nine individuals accused of tarnishing the reputation of Pastor Robert Kayanja have a case to answer must go to trial.

Grade one magistrates Court at Mwanga 11 has ordered the nine youths to defend themselves against charges of trespassing onto Lubaga Miracle centre with intentions of annoying and tarnishing the name of Pastor Robert Kayanja by falsely accusing him of sodomizing them in 2021.

Presiding magistrate Adams Byarugaba has ruled that after listening to  the evidence of 13 prosecution witnesses and analysing exbhits including audio recordings, phone data records and medical examination forms, he has reached a conclusion that a pre-mafacie case has been established against each of the nine suspects and they must offer an explanation to court before a final verdict is announced.  

The court has ruled that prosecuction  has adduced  over whelming evidence to the effect that the youths  who were employees at Lubaga Miracle hatched a plan to get money from pastor Robert Kayanja .

That in  the meeting at Tal cottages, the suspects hatched a plan to falsely accuse Pastor Kayanja of sodomising them thinking that when he hears of the allegations, the Pastor will definitely give them money to drop the accusations  and clear his name .

Hence forth on the 17th September 2021, the suspects who had no prior appointment with Pastor Kayanja, forced their entry  into Lubaga Miracle cathedral and shouted vulgarities with an intention of annoying Pastor Kayanja. 

Further evidence suggests that after thier arrest and detention at Old Kampala police station, the suspects recorded statements while giving false information to police officers that they had been sodomised by Pastor Kayanja well knowing that the police would commit resources to investigate these false allegations because medical examinations from  Mulago hospital and Nsambya Health center showed that they had intact sphincters.

Even though  the youths’ lawyers had challenged prosecution evidence that there is no proof  of  common intention agreement  formed by suspects to annoy  Pastor Kayanja , the court has agreed with chief prosecutor Jonathan Muwaganya that conspiracy is formed in secrecy and inference can be made out through special circumstances. 

Now the  nine have been put to thier defence  however they have not yet indicated to court if they will give a  sworn or unsowrn evidence or will simply keep quiet.

The suspects of whom three are still held on remand, will return to court on the 24th January 2025.
