Prosecution seeks Courts Order to Confiscate Besigye, Lutale Mobile Phones

Nakawa Chief magsitrates court has sent back on remand 4 time presidential candidate Rt. Col Dr Kiiza Besigye and his aide Hajji Obeid Lutale at Luzira prison as the state further investigates their Treason case . 

However chief magsitrate Esta Nyadoi has ordered the State to expedite investigations inorder to observe a speedy and fair trial for the duo and co-suspect Capt. Oola.

Defence lawyers tasked the prosecution team  to state the  exact date when investigations will be completed because their clients have been deprived of their liberty since November last year when they arrested from Nairobi and arraigned before the General Court Martial. 

The prosecution team represented by Richard Birivumbuka responded that it was within the mandatory six months that are stipulated in the Constitution to investigate a capital matter but they were overuled by the magistrate who made it clear that the days of trial by ambush are over and that the state should expedite their investigations. 

Besigye and Lutale who were present in court for the hearing of their case today are said to have connived with a one Capt Dennis Oola to contrive a plot to overthrow the government through subversive acts of holding meetings, giving logistical support and facilitating the transportation of other people to Nairobi to be trained in Terrorism acts. The magistrate has adjourned the case to 28th/ March.

State prosecutors have also filed an application  before the Nakawa court seeking to access, extract and analyse data from Mobile phones belonging to Dr. Besigye, Hajji Lutale and Capt Dennis Oola which they believe might have been used in the commission of the offence. 

Through an affidavit sworn by the investigating officer Detective Ip Bendict Odyek , the state further seeks to confiscate the said mobile phones until the final disposal of the Treason case . 

This application will be heard on 14th/ March.
