Army Court Releases 3 Police Officers On Bail

The General Court Martial at Makindye has so far released on bail 3 out of the jailed 7 police officers battling kidnap charges.

The 7 member court chaired by Lt. Gen Andrew Gutti has released D/CPL Amon Kwarisima , SPC Faisal Katende and D/ASP James Magada after being satisfied that the 3 are junior ranking officers who can neither interfere with on-going CMI investigations nor threaten prosecution witnesses.

The Court has ordered the 3 officers to each sign a ten million shillings non -cash bond and their surities to execute bonds of 5 million shillings each. The bailed officers must also report to the registrar of the General court Martial twice a month and never to travel out of Kampala without permission from court.

The officers have however been warned that failure to abide by any of the terms will automatically led to cancellation of bail. The same court however last month refused to release on bail Asst. Commissioner of police Joel Aguma on grounds that he had capacity to threaten witnesses and interfere with investigations being a high taking officer.

Aguma has since run to the Highcourt's criminal division to re-apply for bail as his co-accused Nixon Agasirwe has asked the same court's civil division to compel the Army court set him free as he is not a Millitary officer to be subjected to Millitary law.

The released officers are part of a group of 7 others including ; Joel Aguma, Nixon Agasirwe Karuhanga, D/ASP James Magada, Benon Atwebembeirwe, Abel Tumukunde who are still in jail over charges of kidnapping 3 Rwandese nationals and unlawfully conveying them to their country against their will.

The remaining officers and the 3 civilian suspects have been now sent back on remand at Luzira prison and Makindye millitary police barracks respectively until the 5th/February/2028 as CMI still carries on-going with its investigations.
